Italy’s upper house of Parliament on Wednesday definitively approved draft law no. 844, thus these provisions are binding law. The law approved by the Senate has not yet been published in the Italian Official Gazette. However, the new provisions provide a 12 months transition period. Accordingly, the new law will be binding 1 year following the publication in the Italian Official Gazette.

By virtue of the new law, the whole regulatory framework on class actions will be found exclusively in the Italian Code of Civil Procedure (artt. 840 bis and ff.).
